This page sets out the information an insurance broker must give a client before a contract is concluded, under Spanish Royal Decree-Law 3/2020 of 4 February, which transposed Directive (EU) 2016/97 on insurance distribution.

Italica acts as an intermediary between you and insurance companies. It is not an insurer and carries no risk of its own. The risk is carried by the company that issues the policy.
2. Registration and supervision
Insurance distribution in Spain is supervised by the Dirección General de Seguros y Fondos de Pensiones (DGSFP, the Spanish insurance and pension funds supervisor), part of the Ministry of Economy.
The brokerage is entered in the DGSFP administrative register of insurance and reinsurance distributors under number [Nº DE INSCRIPCIÓN EN EL REGISTRO DE LA DGSFP]. You can check the entry and its validity in the public register published by the DGSFP at www.dgsfp.mineco.gob.es.
As of the date shown above, registration is still pending. While the application remains open, the brokerage does not carry on insurance distribution and nothing on this site constitutes an offer of intermediation.
3. Nature of the advice
As a broker, Italica advises on the basis of a fair and personal analysis. Before recommending a product, it examines a sufficient number of insurance contracts available on the market for the risk in question and applies professional criteria to explain why that contract meets your demands and needs.
Italica is not the agent of any insurance company and has no exclusive distribution agreement with one.
Italica holds no direct or indirect holding above 10 % of the capital or voting rights of any insurance company. No insurance company, and no parent company of an insurer, holds such a stake in the brokerage.
Before you sign, the brokerage gives you in writing the insurance proposal, the insurance product information document prepared by the insurer, and the reasons for its recommendation. Cover, limits, deductibles and exclusions are those set out in the policy.
4. Remuneration
Italica is paid a commission by the insurance company, included in the premium you pay. The commission is not added to the premium. It forms part of it.
The brokerage tells you the nature of its remuneration in every proposal it presents to you, before you contract.
The brokerage may agree fees payable by you directly. Any such agreement must be in writing, must state the amount, and must be signed before the insurance is contracted. If no fees are agreed in writing, you pay the brokerage no fees.
5. Professional indemnity insurance and financial capacity
The brokerage holds professional indemnity insurance covering its activity throughout the European Union, with the per-claim and annual limits required by insurance distribution rules.

6. Classes of business and products
The brokerage distributes insurance for companies and professionals:
- Property damage and commercial multi-risk.
- General liability.
- Professional liability.
- Directors and officers liability (D&O).
- Cyber risk.
- Fleet and commercial motor.
- Agricultural insurance.
- Warranty and indemnity insurance for company sale and purchase transactions.
The brokerage does not distribute life or health insurance at present. If it extends its activity to those classes, it will update this page.
7. Use of artificial intelligence systems
The brokerage uses artificial intelligence systems in its daily work. These systems gather risk information, request quotations from several insurance companies, compare the offers received and prepare the documentation for the transaction.
A person holding the qualification required of insurance distributors reviews and signs every recommendation and every placement. That person answers for the content of the advice you receive.
Decisions that produce legal effects concerning the client, or similarly affect the client, are not taken by solely automated means, in line with Article 22 of Regulation (EU) 2016/679 (GDPR).
8. Complaints
The procedure has two steps. The first must be completed before you move to the second.
Step 1. The brokerage's customer care service
Submit your complaint to the Servicio de Atención al Cliente (customer care service), governed by Order ECO/734/2004 of 11 March on the customer care departments and services of financial institutions.

Give your name or legal name, your tax number, a contact channel, the facts behind the complaint and what you are asking for. Step 2. Servicio de Reclamaciones of the DGSFP
If the customer care service does not reply in time, or its reply does not satisfy you, you may complain to the Servicio de Reclamaciones (complaints service) of the Dirección General de Seguros y Fondos de Pensiones. The procedure is governed by Order ECC/2502/2012 of 16 November.
The form, the requirements and the electronic filing channel are available at www.dgsfp.mineco.gob.es. You will need to show that you first filed the complaint with the customer care service.
Using these channels does not prevent you from bringing a claim before the courts.
9. Data protection
The processing of personal data of clients, policyholders, insured persons and contact persons is described in the privacy policy, which covers the purposes, the legal bases, the retention periods and how to exercise your rights.
10. Updates to this information
The brokerage reviews this page whenever its registration details, its remuneration structure, its classes of business or the applicable rules change. The date of the last update appears at the top.
